What A.R.S. § 13-3553 Prohibits
A.R.S. § 13-3553 names the offense sexual exploitation of a minor. Child pornography is a commonly used phrase, but it isn’t the statutory charge name. The alleged subsection matters because the statute covers several forms of conduct.
The law addresses knowingly engaging in specified conduct involving qualifying visual depictions, including:
- Recording, filming, photographing, developing, or duplicating a depiction
- Distributing, transporting, exhibiting, receiving, or electronically transmitting a depiction
- Selling, purchasing, possessing, or exchanging a depiction
The statute contains separate provisions involving child sex dolls and observing a nude minor for sexual gratification. Sexual exploitation of a minor is a class 2 felony, and allegations involving a minor under 15 can affect the sentencing analysis. Luring a minor for sexual exploitation, commercial sexual exploitation of a minor, and portraying an adult as a minor are separate offenses with different elements.
